Your legal rights under the proposed Settlement
There are several ways you can participate in the proposed Settlement:
Do nothing
If you agree with the proposed Settlement, you do not have to do anything now.
If the Federal Court approves the proposed Settlement, information will be provided about how to make a claim for compensation. You can sign up for email updates.
Opt out of the proposed Settlement
Opting out means that you will not receive compensation under the proposed Settlement and you wish to maintain your right to bring your own lawsuit for psychological, verbal, physical and/or sexual abuse experienced while admitted to a Federal Indian Hospital.
If you wish to opt out, and do not want to receive compensation under the proposed Settlement, you need to submit Opt Out Form to the Notice Administrator no later than 60 days after the proposed Settlement has been approved by the Court after the June 10-11, 2025 Settlement Approval Hearing. This deadline will be provided as soon as it is available.
There are several ways you can submit your Opt-Out Form:
- Download the Form: You can download the Opt Out Form, fill it out and send it to the Notice Administrator using one of the methods below

Request a Form: You request to have an Opt Out Form sent to you by email at Info-IH@IHClassAction.ca or by calling the Info Line toll free at 1-888-592-9101
Once you have completed your Opt Out Form, you can send it to the Notice Administrator in several ways:

Observe the Settlement Approval Hearing
If you would like to attend the Settlement Approval Hearing, which will take place on June 10 and 11, 2025, you can do this in two ways:
- Attend in person: you can Participate in the hearing in person in Ottawa, Canada.
- Attend online: you can also watch the hearing through a dedicated video link which will be available soon.
You do not have to attend the hearing, even if you sent an Objection or Opt Out Form. Class Counsel will answer any questions and will provide the Federal Court with all completed Objection Forms.
